Permission to Relocate

A first instance decision in the Family Court in West London was published by HHJ Williams In July 2023. This is:  Re M & Anor (Children) (Permanent Relocation)  [2023 EWFC 145 .

This was a comprehensive judgment considering the applicability of the welfare checklist in respect of the contested issues. The judge was tasked to answer the following questions (as outlined at paragraph 3)

1.    Should the mother be granted permission to permanently relocate the children to country X?

2. If the answer to (i) is yes then when should this take place?

3. If the answer to (i) is yes then what contact should there be following relocation?

4. If the answer to (i) is no then what should be the child arrangements in this jurisdiction?
